TERMS & CONDITIONDS OF THE HOME OWERSHIP SCHEME

   


1.0 DELIVERY PERIOD
1.1 Clients shall specify the desired delivery period at the registration for the housing
scheme. The houses shall be given to the clients at the end of the delivery period.


2.0 HOUSE TYPES
2.1 Clients shall specify the desired house type at the registration for the housing scheme.
The house types, floor areas, plot sizes and specifications, can however be improved by
Homes World Limited, subject to agreement between Homes World Limited and the
Clients.


3.0 LOCATION
3.1 Clients only have a choice of a regional capital. The exact site shall be determined by
Homes World Limited. Depending on the availability of land, the location could be outside
the statutory limits of the specified regional capital. Clients are bound to accept one of
the land choices available.


4.0 PAYMENTS
4.1 Payments shall be made each month and directly to FirstBanC Financial Services.
4.2 The payments shall be in Ghana Cedis and the determined amount payable every month
shall remain unchanged over the delivery period.


5.0 GUARANTEES TO CLIENTS
5.1 Payments shall be made directly to FirstBanC Financial Services which shall give the
clients the irrevocable guarantee that they can collect their back except the penalty for
withdrawal any time they so desire.
5.2 Homes world Limited shall give a two (2) year guarantee against all material and
structural defects not arising out of misuse by the client. All such defects shall be put right
by Homes World Limited, without any cost to the client.


6.0 PENALTIES


6.1 WITHDRAWAL FROM SCHEME
Clients who withdraw from the scheme before the delivery date shall forfeit a total of six
(6) months payments, to cover administrative, financial, consultancy and other costs.


6.2 LATE PAYMENTS
For each month that a client defaults in the monthly payment, the delivery date shall
accordingly be extended by the length of the default.
7.0 OTHER OBLIGATIONS OF HOMES WORLD LIMITED


7.1 SITE
Homes World Limited shall indicate to the client the exact location of the site on which
the building shall be constructed, not later than half way through the delivery period.


7.2 BUILDING
Homes World Limited shall indicate to the client the exact house or block of flats under
construction, not later than two years to the delivery date.


7.3 SITE VISITS
Beginning from half way through the Delivery Period, Homes World Limited shall organize
free half yearly visits to the site for clients who so desire.


7.4 STATUTORY AND LEGAL DOCUMENTS
All the required legal and statutory documents on the property shall be given to the client
or before the delivery date.


7.5 AS-BUILT DRAWINGS
All as-built drawings, both Architectural and Engineering shall be given to the client on or
before the delivery date.


8.0 DEFAULT BY HOMES WORLD LIMITED
8.1 If the houses are not delivered to the client at the specified date, FirstBanC Financial
Services irrevocably guarantees to pay back to the client on request, all the money paid
plus 8% compound interest.


9.0 FORCE MAJEURE.
Homes World Limited shall not be liable for failures or delays in performing their
obligations pursuant to this contract arising from any cause beyond their control,
including but not limited to, act of God, acts of civil or military authority,
terrorism, fires, strikes, lockouts or labour disputes, epidemics, wars, riots,
earthquakes, storms, typhoons and floods and in the event of any such delay, the
time for either party's performance will be extended for a period equal to the
time lost by reason of the delay.


10.0 DISPUTE RESOLUTION
1. If any dispute arises in connection with this agreement, Homes World Limited and
the Client shall, within 20 working days of a written request from one party to the
other, meet in a good faith effort to resolve the dispute.
2. (a) If the dispute is not resolved at that meeting the parties will attempt
to settle it by mediation.
(b) Unless otherwise agreed between the parties, the mediator shall be
amicably and mutually nominated by both parties herein.
(c) To initiate the mediation a party must give notice in writing
(ADR notice) to the other party requesting a mediation.
(d) The mediation shall start not later than 20 working days after the
date of the ADR Notice.
3. No party may commence any court proceedings OR arbitration in relation to any
dispute arising out of this agreement until it has attempted to settle the dispute
by mediation, and either the mediation has terminated or the other party has
failed to participate in the mediation, provided that the right to issue proceedings
is not prejudiced by a delay.

WALLS - Concrete, and or sandcrete blocks or burnt bricks.
WINDOWS - BASIC/CLASIC Aluminum glazed blades,
With mosquito-net and burglar proofing.
PRESTIGE Aluminum glazed sliding windows
DOORS - Timber panel doors.
ROOFING - Timber structure with aluminum roofing sheets, or
reinforced concrete slab.
CEILING - BASIC - Painted plywood
- CLASSIC - Plastics T&G
- PRESTIGE - Timber T&G, Plaster of Pairs or painted
soffit of slab. Painted plywood for out- house.
WALL FINISH - ALL - Painting, ceramic tiles in kitchen and bathrooms
FLOOR FINISH - BASIC - Porcelain floor tiles in Living room, kitchen and
bathroom.
- CLASSIC - Porcelain floor tiles except in store and
garage.
- PRESTIGE - Porcelain floor tiles except in store and
garage.
PLUMBING - BASIC - Cold water.
- CLASSIC - Cold water.
- PRESTIGE - Hot and cold water
ELECTRICITY - Single phase conduit wiring.
BUILT-IN FIFFINGS - BASIC Kitchen work top and cupboard.
PRESTIGE/CLASIC – Wardrobes and kitchen cabinets.
FENCEWALL - 1.5m high sandcrete block or burnt brick wall around plot where
Applicable.
SERVICES - Electricity, street lights, water, central sewage system, covered drains
and bitumen surfaced roads.
N.B. After two (2) years, clients shall be responsible for maintaining the services and landscaping.
